Purpose
This Policy explains how Baker Landscape Supples Pty Ltd (ABN 24003039781) protects and manages the privacy of staff, clients and customers.
In this document, “Baker Group”, “we”, “our”, and “us” refer to Baker Landscape Supplies Pty Ltd including all related companies and trusts.
Scope
This Policy applies to all staff, clients, customers and other individuals or entities associated with the business of Baker Group.
Policy Statement
Baker Group and those engaged by or with it are bound by the Privacy Act 1988 (Cth).
At Baker Group, we are committed to protecting the privacy and confidentiality of our staff, clients, customers and other individuals or entities associated with Baker Group.
Baker Group has in place appropriate security measures to protect against unauthorised access to or unauthorised alteration, disclosure or destruction of data. These include internal reviews of data, its storage and processing practices; and other security measures, such as data encryption.
In respect of online access through a web browser to the information protected by this Policy, we may use cookies from Facebook, Google (and other advertisers) to improve your online experience, including the display of more relevant ads. Most browsers are set up to automatically accept cookies but this can be reset by the user, who may opt-out of a cookie at any time by going to the respective Ad Settings in the browser. Note that some of the Baker Group features and services may not function properly if cookies are disabled.
What Personal Information do we collect, what do we do with it and why?
We may collect the following types of information:
- Personal Information – When you sign up with or make a purchase from Baker Group, we ask for your personal information so that we can provide you with a better experience and quality of service. In some instances, personal information will be requested for online functions on the Baker Group website or affiliated websites, and that information will be protected under this Policy.
- Cookies – When you visit Baker Group online, we send one or more cookies to your device so that we can track user trends and store user preferences to improve search results and ad selection. By using cookies, we can improve the quality of our service to you and assist advertisers and publishers to improve their services to us.
- Server Log – When you access the services of Baker Group online, our servers automatically record certain information. This includes your web request, the nature of your interaction with us, your Internet Protocol address, browser type, browser language, the date and time of your request, and the cookie/s that may uniquely identify your browser or your account. These logs are retained for a short period after they are made for anti-fraud and website security purposes. They are then permanently deleted.
- Traffic information – When you access the services of Baker Group online, we record certain information using our traffic analysis tool, Google Analytics. This information is stored in an anonymised manner and includes data such as your web request, your interaction with a service, Internet Protocol address, browser type, browser language, the date and time of your request, and one or more cookies that may uniquely identify your browser or account. These logs are retained for a period of time after being obtained to help us improve our content and marketing. The information is then automatically deleted.
- User communications – When you send an email or other communications to Baker Group, we retain those communications in order to process your inquiries, respond to your requests and improve our services. In the case of text messaging, we may collect and maintain information such as the phone number and the wireless carrier associated with the phone number. Your stored contact information will only be used to send you communications that are related to your purchases or which you have opted into.
- Third Party Applications – Baker Group may make available third-party applications, such as plugins, modules or extensions, through its services. The information collected by Baker Group when you enable a third-party application is processed under this Privacy Policy. However, the information collected by a third-party application provider is not protected under this Policy.
- Location data – Baker Group offers location-enabled services. If you use those services, Baker Group may receive information about your actual location (such as GPS signals sent by a mobile device) or information that can be used to approximate a location (such as a cell ID). This data is not recorded without your permission and is not held for any longer than the period required to deliver the specific service.
In addition to the any purposes mentioned above, we may use the information we collect to:
- provide, maintain, protect, improve and develop our services (including advertising services); and
- protect the rights or property of Baker Group or our users.
If we ever need to use this information in a manner different than the purpose for which it was collected, we will ask for your consent prior to such use.
Personal data obtained will be destroyed or permanently de-identified where it is no longer required by us. Exceptions to this include where active server records or secure backup systems retain residual copies of the data for a period of time before permanent deletion, and where legal obligation requires data retention for a specified period of time. In all instances, the data will be stored securely until removed.
Who will have access to Personal Information?
We are committed to taking all reasonable steps to ensure that all personal information we hold in our servers is not lost, misused or accessed in an unauthorised manner. Baker Group will only share personal information in the following limited circumstances:
- You have requested access to your own information.
- You have provided us with your express, written consent.
- A subsidiary, affiliated company or other trusted business or person is responsible for the handling and storage of this information on our behalf and requires the information to fulfil their contractual role. Such parties will be independently bound by their own contractual agreement with Baker Group to uphold such confidentiality and to be compliant with this Privacy Policy.
- It is reasonably necessary to:
- satisfy any applicable law, regulation, legal process or enforceable governmental order
- detect, prevent, or otherwise address fraud, security or technical issues, or
- protect against harm to the rights, property or safety of Baker Group, its users or the public as required or permitted by law.
What if a person wants to check on their own PI?
An employee of Baker Group can use their personal account on the Baker Group website to view or update their personal information stored in that account.
In accessing personal information from a Baker Group account, individual users are required to identify themselves and the information they are seeking to access. We may decline to process requests that:
- are unreasonably repetitive or systematic
- require disproportionate technical effort
- jeopardise the privacy of others
- would be extremely impractical (for instance, requests concerning information residing on backup tapes), or
- are otherwise unreasonable or unnecessary.
Gaining access to personal information will be free of charge unless a disproportionate effort is required to access it. In this instance a proportionate cost may be payable as determined by Baker Group.
What if this Policy is changed?
This Privacy Policy may change from time to time. Notice in writing will be provided by Baker Group to those covered by this Policy identifying what will be changing, the details of the change and when it will be changing. When the Policy is changed, that new Policy will be distributed to all who are covered by it.
If Baker Group becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, the confidentiality of any personal information kept by Baker Group will be upheld. Notice in writing and an opportunity to respond will be provided to all persons whose personal information is stored by Baker Group before it is transferred. This will include any available information about replacement privacy protections.
Privacy Complaints
Baker Group regularly reviews its compliance with this Privacy Policy. In the event of a formal written complaint as per the Baker Group [Complaints Procedure], Baker Group must consult as soon as practicable with the complainant about his or her concerns. Our best effort will be made to resolve the complaint with the individual. However, where this is not possible, an appropriate regulatory authority may be involved and we will cooperate accordingly.
